Terms of use
1. Acceptance of terms of use.
By creating an account in the Find Me Service - compatibility dating, you agree to abide by these Terms of Use and our Privacy Policy, as well as any conditions agreed with you if you acquire additional functions, products and services as part of Service (hereinafter - the Agreement). If you do not accept all the conditions of this Agreement and do not intend to comply with them, do not use the Service.
We reserve the right to amend this Agreement and Service. The introduction of changes may be due to a number of reasons, including with a view to ensuring the requirements of the law, introducing new functions or changes in the methods of conducting business.
2. Eligibility.
A prerequisite for creating an account and its use is the achievement of 18 years of age. By creating an account and using the Service, you represent and warrant that:
You have the right to enter into a binding agreement with Find Me;
You are not a person who is prohibited from using the Service in accordance with the laws of the Russian Federation or any other jurisdiction. This means that you are not included in the List of Citizens of Special Categories and Prohibited Persons of the Ministry of Finance of the Russian Federation and are not subject to another similar prohibition;
You agree to comply with this Agreement and all applicable local, state, national and international laws and regulations;
You have not been convicted of a criminal offense, an offense subject to prosecution (or a crime of similar gravity), a sexual offense or any other offense involving violence, not registered as a person who committed a sexual offense.
3. Your account.
You can log in to Find Me Find Me with your Facebook account or Apple id. If you log in in this way, you grant us access and permission to use certain information from the provided account, in particular, the public Facebook profile and information about Facebook friends who are also common to you and other Find Me users who have granted permission Facebook to use their personal data. For more information regarding the data that we receive from you, as well as regarding the procedure for their use.
You are responsible for maintaining confidentiality and protecting your credentials used to log in to Find Me. At the same time, you are also solely responsible for all actions that occur using these credentials. If you suspect that someone has gained access to your account, contact us immediately.
The service uses the geolocation of users to improve the operation of certain functions, including finding a compatible user with you as close as possible.
4. Change and termination of the Service.
Find Me is always striving to improve the Service and provide you with additional useful features. This means that we have the right to add new functions or make improvements, as well as delete some functions. If such actions do not significantly affect your rights or obligations, we have the right not to notify you of such actions. We also have the right to completely suspend the provision of the Service, which we will notify you in advance of, except in the event of mitigating circumstances, for example, for security reasons.
You have the right to delete your account by going to "Settings" and then "delete profile". However, if you use a third-party payment account, in-app purchases are managed through the appropriate account (for example, App Store, Google Play). Find me has the right to terminate your account at any time without notice if it considers that you have violated this Agreement. After such termination, you lose the right to a refund of purchases. Upon the termination of your account, this Agreement shall be deemed terminated.
5. Security. Your interaction with other users.
Find Me is committed to encouraging respect for users through features such as confirmation of a notification mailing list, which allows users to communicate only if they are both interested in each other. But Find Me is not responsible for the actions of users within the Service or beyond. You agree to exercise caution when interacting with other users, especially if you decide to meet in person. You agree that you will not provide your financial information (for example, information about your credit card or bank account), as well as transfer or otherwise send funds to other users.
You are solely responsible for interacting with other users.
You understand that Find Me does not check users' criminal records, nor does it request any other personal information from users.
Find Me makes no warranties regarding user behavior.
6. Rights granted to you.
Find Me grants you a personal, royalty-free, non-transferable, non-exclusive, revocable and non-sublicensable license to access and use the Service. This license is intended solely to enable you to take advantage of the Services provided by Find Me under this Agreement. Thus, you agree to:
not to use the Service or any materials within the Service for any commercial purposes without our written consent;
do not copy, modify, transfer, create any derivative works, use or reproduce in any way any copyrighted materials, images, trademarks, company names, service marks or other intellectual property, any materials or official information, available through the Service, without the prior official written consent of Find Me;
Do not attempt to issue any of your statements for allegations approved by Find Me;
do not use robots, bots, spiders, search robots, scrapers, search applications, proxies or other manual or automatic devices, methods or processes for accessing, extracting, indexing, spyware, or in any way reproducing or bypassing navigation the structure or presentation of the Service or its contents;
not to use the Service in any way that may interfere, disrupt or adversely affect the Service, servers or networks connected to the Service;
Do not upload viruses or other malicious code or otherwise violate the security of the Service.
Do not fake headers or otherwise manipulate identifiers in order to hide the origin of any information transmitted using the Service;
Do not create a frameв or mirror of any part of the Service without the prior official written permission of Find Me;
do not use meta tags, code or other devices containing any links to Find Me or the Service (or any trademarks, trademarks, service marks, logos or slogans of Find Me) in order to direct any person to any other website in any goals;
not modify, adapt, sublicense, translate, sell, reverse engineer, decrypt, decompile or otherwise disassemble any part of the Service or encourage others to do so;
Do not use or develop any third-party applications that interact with the Service or Materials of other users, without our written consent;
Do not use, access or publish the Find Me application programming interface without our official written consent;
Do not investigate, scan or test the vulnerability of our Service, any system or network;
not encourage any action that violates this Agreement.
Find Me has the right to investigate and take any legal action available in response to illegal and / or unauthorized use of the Service, including the termination of your account.
Any software we provide you with can automatically download and install updates or other new features. You can configure automatic loading using the settings menu of your device.
7. The rights that you grant Find Me.
By creating an account, you transfer Find Me a universal, assignable, gratuitous right with the possibility of sublicensing and permission to post, store, use, copy, display, reproduce, adapt, edit, publish, modify and disseminate the information that you provide access through a social network Facebook, as well as any information that you publish, upload, display or make available to other users in any other way. Find Me permission to use your Materials is non-exclusive, except for Find Me exclusivity with respect to derivatives created using the Service. For example, Find Me has exclusive rights to screenshots of the Service, including your materials. In addition, in order to protect your Materials from being used outside the Service, you grant Find Me the right (but not the obligation) to act on your behalf in relation to violations related to the use of your Materials removed from the Service by other users or third parties. Our permission to use your Materials is subject to applicable laws (for example, laws on the protection of personal data to the extent that any Materials are considered to contain personal data in accordance with these laws) and are used solely to ensure the functioning, development and improvement of the Service and the provision of related services, as well as research and development of new services. You agree that any Materials that you post on the Service,can be viewed by other users and any person visiting the Service or participating in the work of the Service (including persons who receive forwarded Materials from other Find Me users).
You agree that all the information that you provide when creating your account, including the information provided in your Facebook account, is accurate and true, and that you have the right to post Materials on the Service and provide Find Me with the above license.
You understand and agree that we have the right to track or view any Materials that you post as part of the Service. We have the right to completely or partially remove any Materials that, in our own opinion, violate this Agreement or may damage the reputation of the Service.
By communicating with our customer service representatives, you agree to be respectful and good-natured. If we believe that your behavior towards our customer service representative or other employees is threatening or offensive, we reserve the right to terminate your account immediately.
Due to the fact that Find Me allows you to use the Service, you agree that we, our affiliates and independent partners have the right to advertise within the Service. By submitting offers or reviews regarding Find Services to Find Me, you agree that Find Me has the right to use and transmit these reviews for any purpose without paying you any compensation.
We hereby inform you that Find Me has the right to receive, store and disclose information about your account and Materials, if it is required by law or to fulfill this agreement with you, if the Company conscientiously believes that such access, storage or disclosure is carried out on legally for the purpose of:
Execution of a court order;
Ensuring compliance with the requirements of the Agreement;
Satisfaction of the claim that any Materials violate the rights of third parties;
Satisfying your customer service request;
Protecting property rights or ensuring the personal safety of the Company or any other person.
8. Community rules.
Using the Service, you agree to:
Do not use the Service for any purpose that is prohibited by this Agreement;
Do not use the Service for the purpose of causing harm or with malicious intent
Do not use the Service to harm Find Me
Do not violate our agreement, updated from time to time.
Do not send spam, ask for money from users or deceive them;
Do not impersonate any person or organization or publish any image of another person without his or her permission;
Do not intimidate, annoy, threaten, insult, humiliate or slander any person;
Do not post Materials that violate anyone rights, including rights to publicity, privacy, copyright, trademarks or other intellectual property rights or rights arising from the contract;
Do not post materials that express hatred, threats, or sexual or pornographic material; incite violence; contain nudity, graphic or gratuitous violence;
Do not post materials promoting racism, intolerance, hatred or physical threats of any kind against any person or group of persons.
Do not request passwords for any purpose or personal data for commercial or illegal purposes from other users or distribute personal data of other persons without his or her permission;
Do not use another user's account, transfer your account to another person or create more than one account.
Do not create other accounts if we have already terminated your account, if you do not have permission to do so;
Find Me reserves the right to investigate and (or) terminate your account without refund of any purchases if you violate the terms of this Agreement, abuse the Service or if, in the opinion of Find Me, your behavior is unacceptable or illegal, including actions or Messages both within the Service and outside it.
9. Materials of other users.
Find Me reserves the right to review, prevent downloading through the Service and remove Materials that violate this Agreement. But the sole responsibility of such Materials lies with the user who posts them; Find Me does not warrant that all Materials comply with this Agreement. All unwanted materials that have passed the download will be deleted by the Service within 24 hours. If within the Service you see Materials that violate this Agreement, report it using the Service or through the feedback page.
10. Shopping.
General Provisions Find Me is entitled to periodically offer paid products and services (in-app purchases) through the App Store, Google Play, mobile operator, Find Me payment service or other payment platforms authorized by Find Me. To make a purchase in the application, you need to confirm the payment with the relevant payment operator and the selected payment method (bank card or a third-party payment service, for example, Google Play or the App Store) (hereinafter referred to as the payment method); this payment method will be used to pay in the application of the selected service and write off the amount indicated for this service, including any applicable fees and taxes. Confirming the payment, you give Find Me or a third-party payment service consent to write off the corresponding amount.If you use the application to purchase a periodic subscription with automatic renewal, the subscription fee will be charged from your IAP account continuously until you cancel it. Upon the expiration of the initial subscription and subsequent subscription periods, it will be automatically renewed for the appropriate period at the price agreed upon when subscribing.
Auto Renew; automatic card payment
The subscription will automatically renew until it is canceled or suspended. After purchasing a subscription, every month within 24 hours before the due date of payment, you will be charged a payment amount corresponding to the amount to which you agreed at the time of subscription; Payment will be made by the method selected upon subscription. Bank card payment details will be stored and subsequently used for automatic card payments in accordance with the terms of the Agreement.
After each payment, the check will be sent to the specified email address. If you do not agree with the payment already debited, send your objections to the customer support service, if the debiting was made directly through Find Me, or to the corresponding third-party payment service, for example, iTunes. You can also appeal the payment by contacting the bank or the payment service provider, who will inform you of your rights and established deadlines for the return.
You can at any time unilaterally withdraw your consent to automatic payment by card in the settings of Find Me or the corresponding third-party payment service, however you must pay all the amounts due at that time.
To change or terminate a subscription, log in to a third-party account (or in Account Settings in Find Me) and follow the instructions to terminate or unsubscribe (even if you deleted your Find Me account or application from the device). When you delete a Find Me account or Find Me application from a device, the subscription is not canceled and its action does not expire; Find Me will continue to debit funds with the selected payment method until the subscription is terminated or the subscription is canceled in Find Me or in a third-party account. When canceling or terminating a subscription, you can use the subscription until the end of its period; when the period expires, the subscription does not renew.
Additional conditions applicable in the case of payment through Find Me through the selected payment method. When paying Find Me directly, Find Me can correct any errors in payments at your request, even if a payment request has been sent or a payment has already been received. If you begin to process a refund or otherwise cancel a payment made using the selected payment method, Find Me has the right to immediately terminate your account at its discretion.
You can change the payment method in Find Me or in the "Settings" section. If the payment was not made due to the expiration of the payment method, insufficient funds or for other reasons, and you did not change the information on the payment method, did not stop or cancel the subscription, you are responsible for unfulfilled payments and agree that we will continue to debit the payment by your chosen method - possibly after updating it. Due to this, your billing dates may change. In addition, you agree that we will receive updated or new validity periods and your credit or debit card numbers from the issuing bank of the corresponding credit or debit card. Terms of payment depend on the chosen Method of payment and may be determined by agreements between you and the financial institution, credit card issuing bank or other provider of the selected payment method.
Virtual items. You have the right to acquire a limited, personal, non-transferable, non-sublicensable, revocable license to use virtual items (hereinafter referred to as Virtual Items). The Virtual Items balance displayed in the account is not a real balance and does not reflect any stored value. It is a measure of the evaluation of your license. Virtual items do not charge for non-use. However, the license granted to you in relation to Virtual Items will be terminated in accordance with the terms of this Agreement if Find Me stops providing the Service or if your account is closed or ceases to operate.Find Me reserves the right, at its discretion, to charge a fee for access to Virtual Items and / or may distribute Virtual Items for free. Find Me has the right to manage Virtual Items, as well as to regulate, control, modify or destroy them. Find Me is not responsible to you or to third parties for the exercise of these rights. Virtual items can only be purchased as part of the use of the Service. ACQUISITION AND REDEMPTION OF VIRTUAL ITEMS WITHIN THE SERVICE IS FINAL AND NOT SUBJECT TO COMPENSATION. The provision of Virtual items for use within the Service is a service that begins to operate immediately after the confirmation of the purchase of Virtual items. YOU ACKNOWLEDGETHAT FIND ME IS NOT OBLIGED TO RETURN MONEY FOR VIRTUAL OBJECTS OR OTHERWISE COMPENSATE THE UNUSED VIRTUAL OBJECTS AS IN CASE OF A VOLUNTARY CASE.
Refund As a rule, all expenses related to purchases are not reimbursed. Also, no refunds or loans are provided in case of early cancellation. We have the right to make an exception if a refund for the subscription was requested within fourteen days from the date of the transaction or if such a refund is provided for by the laws of your country.
The acquisition of Virtual Items is FINAL and NOT SUBJECT TO REFUND.
To request a refund:
If you subscribed through your Apple ID, then the refund is made through Apple, not Find Me. To request a refund, open iTunes, click on your Apple ID, select "Purchase History", find a deal and click "Report a Problem." You can also send a request to https://getsupport.apple.com.
If your subscription is through a Google Play Store account or through Find Me directly, contact customer support with the Google Play Store order number (the order number can be found in the order confirmation email or in your Google Wallet account) or the Find Me number (listed in confirmation email). You also have the right to inform that you, as a buyer, cancel this agreement, as well as any such action by sending a letter or providing a notification with the date and signature. In the notification, in addition to the order number, please indicate the email address or phone number registered in the account. 11. Notification and procedure for filing complaints of copyright infringement.
If you believe that your personal data and materials have been copied and posted as part of the Service (copyright infringement), provide our copyright agent with the following information:
electronic or physical signature of a person authorized to act on behalf of the copyright holder;
a description of the copyrighted work that you claim has been violated;
a description of the location in the Service of material that infringes copyrights (such a description must be detailed enough so that we can find material that infringes copyrights);
Your contact information, including address, phone number and email address;
a written statement from you that you conscientiously consider that disputed use is not permitted by the copyright owner, its agent or the law;
a statement made by you under penalty of perjury that the above information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.

12. Disclaimer.
FIND ME provides services in the existing conditions and for their ability, in accordance with applicable law and MAKES NO EXPRESS, IMPLIED, STATUTORY OR OTHERWISE WITH RESPECT TO THE SERVICE (INCLUDING ALL MATERIALS), IN PARTICULAR, ANY IMPLIED WARRANTIES OF SATISFACTORY QUALITY, MERCHANTABILITY SUITABILITY FOR A PARTICULAR PURPOSE OR NON-VIOLATION OF RIGHTS. FIND ME DOES NOT WARRANT THAT: (A) THE SERVICE WILL WORK UNINTERRUPTED, SAFETY OR ERROR-FREE; (B) DEFECTS OR ERRORS IN THE SERVICE WILL BE CORRECTED; (C) MATERIALS OR INFORMATION WHICH YOU WILL RECEIVE THROUGH THE SERVICE IS EXACT.
FIND ME DOES NOT RESPONSIBLE FOR MATERIALS THAT YOU OR ANOTHER USER OR THIRD PARTY POSIT, SEND OR RECEIVE THROUGH THE SERVICE. YOU MAKE ACCESS TO MATERIALS DOWNLOADED OR OTHERWISE OBTAINED BY USING THE SERVICES, AT YOUR OWN RISK AND RISK.
13. Services of third parties.
The service may contain advertisements and promotions offered by third parties, and links to other websites or resources. The company is not responsible for the availability (or lack of availability) of such external sites or resources. If you decide to interact with third parties using the Service, your relations with them are governed by the terms of third parties. Find Me is not responsible for such conditions or the actions of third parties.
14. Limitation of liability.
PURSUANT TO APPLICABLE LAW, COMPANY FIND ME, ITS AFFILIATES, EMPLOYEES, LICENSORS OR SUPPLIERS SERVICES SHALL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, CONTINGENT, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING, DIRECT OR INDIRECT LOSS OF PROFITS, OR WHAT - OR LOSS OF DATA, OPPORTUNITY TO USE, LOSS OF REPUTATION OR OTHER INTANGIBLE DAMAGES RESULTING FROM:
YOUR ACCESS OR USE OR IMPOSSIBILITY OF ACCESS OR USE OF THE SERVICE;

UNAUTHORIZED ACCESS, USE OR CHANGE OF YOUR MATERIALS, EVEN IF FIND ME WERE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES. THE COMPLETE RESPONSIBILITY OF FIND ME WITHIN ALL CLAIMS CONCERNING THE SERVICE MAY NOT EXCEED THE AMOUNT PAID BY YOU TO FIND ME FOR THE SERVICE, IF YOU HAVE AN ACCOUNT.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSIONS OR LIMITATIONS OF CERTAIN DAMAGES, SO, SOME OR ALL EXCEPTIONS AND LIMITATIONS SPECIFIED IN THIS SECTION MAY NOT APPLY TO.
15. Arbitration, waiver of a class action and refusal to consider a suit by a jury.
With the exception of users residing in the European Union, the European Economic Area and in other countries where this is prohibited by applicable law:
The only way to resolve any dispute or claim arising out of this Agreement or relating to it (including any alleged violations) or the Service is MANDATORY ARBITRATION at the American Arbitration Association in accordance with the Rules for Arbitration of Consumer Claims. The only exception to the exclusivity of arbitration is that you have the right to file an individual lawsuit against the Company in a petty litigation court of competent jurisdiction. Regardless of your decision to appeal to a compulsory arbitration or a court of petty litigation, you have no right to initiate or take part in the filing of any class actions or other representative claims and proceedings against the Company.
By using the Service, you agree to the above arbitration agreement. At the same time, YOU REFUSAL OF YOUR RIGHT TO APPLY TO THE COURT to file a claim or defense in the framework of relations between you and the Company (with the exception of issues that may be examined by the court of small litigation). YOU ALSO REFUSE YOUR RIGHT TO PARTICIPATE IN GROUP SUITS OR OTHER GROUP PRODUCTIONS. Your rights are determined by NEUTRAL ARBITRATOR, NOT BY JUDGE OR JURY. The decisions of the arbitrator may be enforced in court and may be set aside by the court on the basis of limited reasons.
Any litigation for the enforcement of this arbitration agreement, including any litigation for the confirmation, amendment, or release of an arbitral award, may be initiated in any court of competent jurisdiction. In the event that this arbitration agreement is deemed unenforceable for any reason, any litigation against the Company (with the exception of the Small Claims Court) may only be initiated in federal or state courts located in Dallas County, Texas. You hereby expressly accept the jurisdiction of these courts in this context.
This Agreement and any dispute between you and the Company shall be governed by the laws of the State of Texas without regard to the principles of conflict of law provided that such an arbitration agreement is governed by the Federal Law on Arbitration.
The European Commission's online dispute resolution platform is available at http://ec.europa.eu/odr . Find Me does not participate in consumer arbitration dispute resolution procedures for users residing in the EU or the European Economic Area.
16. Applicable law.
For users residing in the European Union, the European Economic Area, or in other countries where our arbitration agreement is prohibited by law, any disputes arising from this Agreement or the Service are subject to the laws of the state of Texas, USA, with the exception of the principles of the conflict of laws of the state of Texas . Notwithstanding the foregoing, the Arbitration Agreement is governed by the Federal Arbitration Law. For the avoidance of doubt, choosing Texas law as applicable does not replace other mandatory consumer protection laws in such jurisdictions.
17. Place of settlement of disputes.
Except for users residing in the EU or the European Economic Area who may make claims in their country of residence in accordance with applicable law, and also with the exception of claims that may be duly examined by the Small Claims Court of the relevant jurisdiction in your area of ​​residence or in Dallas County , Texas, all claims arising out of use or related to the Service or your relationship with Find Me, which for any reason are not referred to arbitration, will be considered solely by the federal or state courts of Dallas County, Texas, USA. You and Find Me agree to the jurisdiction of the Texas courts and refuse statements that there is no close relationship between the dispute and its place of jurisdiction.
18. Warranty of damages and protection against liability by the user.
You agree (to the extent permitted by applicable law) to protect and protect Find Me, our affiliates, them and our officers, directors, agents and employees from any claims, requirements and obligations.
You agree to indemnify for losses, costs and expenses, including attorneys' fees, arising or related in any way to your access to the Service or its use, your Materials or your violation of this Agreement.
19. The exhaustive nature of the agreement and other conditions.
This Agreement and the Privacy Policy, as well as any conditions disclosed and agreed upon with you when purchasing additional functions, products or services that we offer as part of the Service, constitute the entire agreement between you and Find Me regarding the use of the Service. If any provision of this Agreement is invalidated, the remainder of this Agreement shall remain in full force and effect. The refusal of the Company to exercise or apply any rights or provisions of this Agreement does not mean a refusal to exercise or apply such a right or provision in the future.
You agree that your Find Me account is not transferable, and all of your rights with respect to your account and Materials will cease to apply in the event of your death. This Agreement does not create a joint venture, agency, partnership, labor, trust or any other relationship. However, you are not entitled to make any statements or accept any obligations on behalf of Find Me.
